Orestes considers himself a savvy social media “influencer” with two million Twitter followers and one million Instagram followers. He’s used to using his “influencer” to get free goods and services in exchange for offering them “exposure” by praising them on his social media feeds. He approaches a new restaurant, called “The Furies,” and says that he’ll say nice things about it on his social media feeds in exchange for a free meal and free drinks. The restaurant refuses and, when Orestes becomes angry, they tell him to leave and never come back. Orestes then makes several angry tweets. One says, “The Furies sucks! Don’t eat there!” Another one falsely says, “Got food poisoning at The Furies. No wonder I saw rats and cockroaches all over that place!” Wouldeither of his tweets constitute a tort? If so, which one? If so, explain which tort and why it would constitute a tort. Talk about both torts and explain why each one does or does not constitute a tort.
