Leena rented a furnished apartment in her building to Tara a medical student for 9 months beginning June 1.

Tara prepaid the first month’s rent. When Tara arrived at the apartment on June 1, Reema, the prior tenant, was still there despite the fact Reema’s rental term had ended on May 15.

Tara complained to Leena and Leena was able to evict Reema by June 15. Tara took possession of the apartment on June 16.

The apartment above Tara’s was occupied by Coco, a member of an up-and-coming band, The Generations. The band’s daily rehearsals interfered with Tara’s studies so much that she complained repeatedly to Leena about the continuing noise.

On July 15, The Generations were arrested at Coco’s apartment for disturbing
the peace. After that Tara was spared the noise from rehearsals.

Beginning July 16, the shower in Tara’s
apartment delivered only cold water. Tara complained, and Leena promptly hired a plumber to fix the problem.The repair only worked for a week. Tara was too busy with her studies to tell Leena.

On August 30, Tara’s stove in her apartment stopped working. On August 31, Tara, disgusted with all these events, knocked on Leena’s door, gave the key to Leena, and said,.”This place is a zoo; I wouldn’t live here if you paid me!” Leena took the key and said, “Sure, okay, if that’s how you feel.” Tara stopped paying rent and never returned to the apartment.

Leena commenced a lawsuit against Tara for breach of her lease and special damages for past due and prospective rent.
